John Marcolini
Biography: John Marcolini represents companies and individuals in commercial, construction and real estate litigation, including complex multiparty cases, before state and federal courts. He also handles zoning, planning and land use matters on behalf of and against municipal governments, as well as matters involving governmental administration, public contracting, public bid dispute actions, election law litigation and public works construction project litigation. He regularly appears before state and county administrative agencies, including the Arizona Registrar of Contractors and Arizona Office of Administrative Hearings, and in alternative dispute resolution proceedings such as actions before the American Arbitration Association (AAA) and National Association of Securities Dealers (NASD). His practice also includes transaction representation in commercial and residential real estate acquisitions and dispositions (including large shopping centers), land use entitlements, business transactions, corporate formation and operations and corporate and limited liability company governance.

Mr. Marcolini’s construction litigation experience includes representing contractors and engineers in claims by and against the government involving wastewater treatment plants, pumping stations and wastewater sewerage systems. He has also represented governmental entities in U.S. Clean Water Act Grant Compliance Audits before the U.S. Environmental Protection Agency in actions where the federal government has disallowed grant reimbursement requests and sought return of grant payments valued in the millions of dollars based on alleged non-compliance by the grantee with grant regulations.
